Auction terms and conditions

Tauler&Fau, S.L. (hereinafter also referred to as the Auctioneer), with CIF number B-87636981 and domiciled in Madrid at Calle Marqués de Urquijo, 34, 2º Exterior Derecha., has as its object the auction of numismatic material.

The participation in the auctions organized by Tauler&Fau, S.L. supposes the unlivable acceptance of the totality of the conditions that are established as follows.

Tauler & Fau, S.L. may modify the conditions at any time to adapt to their activity and improve it. It shall be deemed fulfilled the obligation of notification, by publication on the website of its ownership www.tauleryfau.com.

Obligation of registration and identification

Individuals and legal entities interested in acquiring the numismatic material to be auctioned must register through the section of the website set up for this purpose (here) and accept the present conditions of purchase at auction established by Tauler&Fau, S.L.

Once the registration is completed and the above documentation is provided, the person may place bids through any of the options set out below.

Also, anyone who would like to participate for the first time in the auctions of TAULER Y FAU S.L. must provide commercial references.

Condition of the numismatic material

The numismatic material will be auctioned in the state in which it is and has been described in the auction notice.

Tauler&Fau, S.L., guarantees the authenticity of the numismatic material, which appears in the auctions, unless otherwise indicated. To that effect, a certificate of authenticity is issued (printed or digital), except in the case of the lots included in the thematic auctions, referenced under the text “Only 10% Commission”, in which they will be exclusively digital and will be available by downloading in PDF through “My Account” panel.

In any case, before placing the bid, the Owner-Seller may physically examine the numismatic material subject to auction at the facilities of TAULER Y FAU S.L., upon written request, by e-mail to [email protected] and on the date and at the time indicated by the latter.

Starting and auction prices

The starting and auction prices of the numismatic material and the payments of the purchases made shall be in (€) Euros.

The starting price shall be fixed in the auction notice and shall consist of the minimum price at which each lot may be awarded, and no bid lower than this price shall be accepted. All bids shall be made in Euros (€) and without cents.

Bids

Any participant in the auction may bid through the options established for this purpose, which may consist of any of those set out here (bidding through the website of Tauler & Fau, SL, online bidding in real time, telephone bidding, bidding by email or bidding through international platforms). In the case that the auction is held in person, the bid may be made in the act itself.

The participant is personally responsible for the bids placed at the auction and assumes participation subject to the rules of the auction and its outcome, as well as the obligations set out in these conditions. The Auctioneer shall not be liable for any errors made by the participant in the bidding process.

All lots are sold at the lowest possible price, with the bidding order prevailing over the live bid. In case of the same bidding orders, priority will be given to the bid received first.

The bidding sections during the live auction will be as follows:

  • Up to €100 an increase of 5€ is applied.
  • Up to 300€ an increase of 10€ is applied.
  • Up to 500€ an increase of 20€ is applied.
  • Up to 1.000€ an increase of 50€ is applied.
  • Up to 3.000€ an increase of 100€ is applied.
  • Up to 5.000€ an increase of 200€ is applied.
  • Up to 10.000€ an increase of 250€ is applied.
  • Up to 20.000€ an increase of 500€ is applied.
  • Up to 50.000€ an increase of 1.000€ is applied.
  • Up to 70.000€ an increase of 2.500€ is applied.
  • Up to 100.000€ an increase of 5.000€ is applied.
  • From 100.000€ an increase of 10.000€ is applied.

 

Method of payment

After the award of the lots, Tauler&Fau, S.L. will send the corresponding proforma invoice to the successful bidder-buyer by email within 1 hour after the end of the auction, which will include the award price.

The successful bidder-buyer shall pay the invoice, through any of the following options, free of charge for Tauler & Fau, S.L.:

  1. By credit or debit card (VISA-MASTERCARD), with a limit of 6.700 €, without additional charges.
  2. Through Bizum (only if the payment is made from Spain), with a limit of €2,500, with no additional charges.
  3. By bank transfer.
  1. Through Paypal with a 6% surcharge on the total amount of the invoice.
  2. In cash only for invoices with a maximum amount of €1,000 for Spanish residents and €10,000 for foreign residents.

 

Payment of the invoice must be made within a maximum period of 20 days from receipt and, in any case, before shipment or collection of the numismatic material, which is the object of the award.

Intermediary commission

The invoice will include, in addition to the award price, a commission of 20% (VAT included), in the concept of intermediation expenses of the Auctioneer in the auction, which shall be paid by the Awardee-Buyer to Tauler&Fau, S.L.

Insurance and shipping costs

The shipments of the numismatic material are made by courier or by registered post, depending on the destination, unless the Awardee-Buyer requests its collection in the office of Tauler&Fau, S.L., personally or through a representative duly empowered.

The shipping costs of the awarded numismatic material and its corresponding insurance contracted by the company providing the shipping service, which can be consulted here (Shipping policy), shall be paid by the successful bidder-buyer and, therefore, will be additionally included in the invoice and paid by the auctioneer.

In any case, Tauler&Fau, S.L. will be responsible for the eventual damages that the numismatic material may suffer during its shipment.

Return of the numismatic material

In case the acquired numismatic material has any defect not described in the auction announcement, the successful bidder-buyer may proceed to the resolution of its sale and its return within a maximum period of 7 calendar days following the date of receipt of the numismatic material, prior to written notification to Tauler&Fau, S.L., indicating the reason for the resolution in a reasoned and justified manner. The amount, if any, is subject to refund shall not exceed the amount previously paid by the successful bidder-buyer.

Any aspect reflected in the auction announcement or the discrepancy regarding the degree of preservation shall not be a reason for a refund.

Any returned numismatic material must be in the same condition in which it was delivered to the successful bidder-buyer, otherwise, the bidder-buyer should be in charge of all the costs of restoration, as well as the damages caused to Tauler&Fau, S.L. and the Owner-Seller as well as to third parties.

Non-compliance with payment obligation

If 20 days have passed since the end of the auction and the successful bidder-buyer has not paid the amount due, TAULER Y FAU, S.L. reserves the right either to terminate the sale and dispose of the numismatic material or to demand payment of the amount due and, in both cases, to claim payment of the damages caused.

Incidents

Tauler & Fau, S.L. will not be responsible for incidents, errors, or delays in connectivity or access that may occur for reasons not attributable or attributable to third parties, such as interruption of telephone or telematic connection, or by accident or force majeure.

Proper use of the service

The participant in the auction must make diligent use of the services offered by Tauler & Fau, S.L. and in accordance with the conditions established by the latter, will not use them to carry out any practice prohibited by current regulations or by the uses and customs of trade. In this sense, the participant in the auction will be the only one responsible for any claim or action, judicial or extrajudicial, initiated by third parties and arising from illegal or negligent use.

Also, Tauler & Fau, S.L. reserves the right to cancel the account of any person and/or to restrict access to its website, when they make improper use of them, as well as to claim the payment of compensation for damages caused.

Admission of registration and bids and disposition

Tauler & Fau, S.L. reserves the right to admit or decline any bidding order that may alter the normal development of the auction.

Also, Tauler & Fau, S.L. will have the power to cancel, reunify, or alter the order of sale of those lots that at its discretion is more appropriate.

Import and export obligations.

In accordance with the provisions of the Spanish Historical Heritage Law and the regulations that develop it, numismatic material that is more than 100 years old will require the express prior authorization of the Ministry of Culture to leave Spanish territory. Likewise, when the country of destination is not in the European Union, a fee will must be paid, this fee will be paid by the successful bidder-buyer, the amount of which can be consulted at the following link.

When the numismatic material is less than 100 years old, it will be necessary to obtain authorization for export outside the European Union in the cases established in Council Regulation (EC) 116/2009 of 18 December 2008 on the export of Cultural Goods.

Likewise, in accordance with the provisions of the Customs Code of the European Union and the other national and international regulations applicable in this area, when the numismatic material is exported outside the European Union or within, in those cases provided for in the same, it will be necessary to comply with the customs and tax formalities provided for in these regulations.

It is the responsibility of the successful tenderer-buyer to obtain the necessary authorization and, if applicable, to pay the corresponding fee, as well as to implement the corresponding customs and tax formalities.

Any delay in obtaining the authorization or implementing the customs and tax formalities shall not release the successful tenderer-buyer from the obligation to pay the due amount.

In any circumstances, the shipment of numismatic material be dispatched until the aforementioned export licenses have been obtained.

The estimated time for the issuing of the export licenses is approximately 2-3 weeks. This period may vary because it depends exclusively on the Ministry of Culture of the Spanish Government.

It is the responsibility of the Awardee-Buyer to comply with the obligations and procedures established in the country of destination for the import of numismatic material. In no case, Tauler&Fau, S.L. will be responsible for the non-observance by the successful bidder-buyer of these obligations and formalities and for the possible consequences.

Protection of personal data

Both Tauler&Fau, S.L. and the successful bidder-buyer will be exclusively responsible for compliance with national and EU regulations on the protection of personal data (Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights and General Data Protection Regulation).

The successful bidder-buyer knows and authorizes that their personal data are included in files under the responsibility of Tauler & Fau, SL (CIF no. B-87636981 and residing in Madrid, Calle Marqués de Urquijo, 34, 2º Ext. right), whose purpose is the maintenance, fulfillment, and execution of contractual relations with the successful bidder-buyer.

Also, Tauler & Fau, SL may use personal data for compliance with current regulations on money laundering, as well as to manage the sending of information about their activities and services through any means (by way of example, email, SMS, WhatsApp), in the case of having the consent to do so.

It is essential to provide the data requested in the registration process, as well as any other data that may be necessary to place bids and/or deliver the numismatic material, to comply with the regulations in force on money laundering, and to send information on activities and services.

The legal basis that legitimizes the processing of data subjects is the need for the maintenance, enforcement, and implementation of contractual relations between the parties and compliance with current regulations on money laundering, as well as consent to the sending of information on the activities and services of Tauler & Fau, SL.

The data will be kept for the duration of the contractual relationship and, subsequently, for the necessary legal period.

The data will not be transferred or communicated to third parties, except that it is necessary to transmit them to the courier company for the shipment of numismatic material and/or for the fulfillment of legally established obligations and/or when they are claimed by any administrative or judicial authority.

Tauler & Fau, S.L. may communicate personal data to certain companies or professionals who, in their capacity as managers, treat certain personal data for the provision of services to Tauler & Fau, S.L. (such as hosting services).

In any case, the successful bidder-buyer may exercise their rights of access, rectification, deletion, opposition, limitation, and portability to Tauler & Fau, SL, through written communication to the email address [email protected] providing a photocopy of their CIF, ID card or equivalent document and identifying the right being sought. Likewise, if they consider their right to the protection of personal data to have been violated, they may complain to the Spanish Data Protection Agency (www.aepd.es).

The successful bidder-buyer is responsible for the truthfulness, accuracy, and updating of the data provided, as well as for any damages that may arise from non-compliance with the aforementioned obligation.

The AUCTIONEER has adopted all the technical and organizational measures necessary to guarantee the security and integrity of the personal data processed, as well as to avoid its loss, alteration and/or access by unauthorized third parties.

Invalidity and ineffectiveness of clauses

If any clause included in these Conditions is declared totally or partially null and void or ineffective, such nullity or ineffectiveness shall only affect such provision or the part thereof that is null and void or ineffective, and the Conditions shall survive in all other respects, and such provision or the part thereof that is affected shall be deemed not to have been included.

Applicable law and jurisdiction

These conditions are governed by Spanish Law, and the Spanish Courts and Tribunals shall be competent to hear any questions that may arise about the interpretation, application, and fulfillment of these conditions. In the event of any discrepancies between the parties due to the auction operations, both parties, waiving any other jurisdiction that may correspond to them, shall submit to the jurisdiction of the Courts and Tribunals of the city of Madrid.

The text binding on the parties involved in the Auction is the one published in Spanish, and any additional texts shall be submitted to the original in Spanish.
